Terms of use
The rules that apply when you use SwissSuccession.
1. The service
SwissSuccession is an intermediation platform. We publish anonymous profiles of businesses open to succession, allow qualified buyers to request access to confidential details, and provide a channel in which the parties can exchange documents and offers. We are not a party to any transaction.
2. Accounts
You must give accurate details, keep your access credentials to yourself and be authorised to act for any company you represent. We may suspend an account that misrepresents who is behind it.
3. Confidentiality
Confidential details are released only after you accept the confidentiality undertaking and the owner approves your request. You may use that information solely to evaluate the transaction, and you may not approach the staff, clients or suppliers of the business on the basis of it.
4. Listings
Owners are responsible for what they publish and warrant that they may offer the business for transfer. Listings are reviewed before publication and may be declined or withdrawn.
5. Fees
Browsing, listing and access requests are free. A success fee is due when an introduction made through the platform results in a completed acquisition, on the terms shown and accepted before each access request, and for the protection period stated in that agreement.
6. No advice
Nothing on the platform is legal, tax, financial or investment advice. Indicative valuations and financing calculations are orientation tools. Take professional advice before signing anything.
7. Liability
We provide the platform with due care but cannot guarantee the accuracy of information supplied by users, the completion of any transaction, or uninterrupted availability. Liability is limited to the extent permitted by Swiss law.
8. Termination
You may close your account at any time. Obligations of confidentiality and any accepted success-fee agreement survive closure.
9. Governing law
Swiss law applies. The place of jurisdiction is the registered seat of the operator.
